Business and Commercial Litigation

Business and Commercial Litigation is considered the most complicated and involved legal proceedings known.

Any litigation can have a major impact on business. The dispute can be internal or external.

An example of an internal dispute could be between business partners, company directors or shareholders.

Litigation from an external claim could be breach of contract, misleading and deceptive conduct or recovery of debts.

Litigation usually involves a dispute between two or more companies or business people, who have been unable to negotiate a mutual resolution. Litigation commences when one of those companies believes only a Court or Tribunal can determine the outcome of the dispute.

We always recommend to set up your business or company practice with the right legal advice, from the beginning. Often, this may be simply having properly prepared terms and conditions put in place for your business dealings. For more information on how we can ensure your business is protected, visit our Business and Commercial section.

When you are investing so much of your time, money and energy into a business, we recommend protecting yourself from the worst case scenario with help from Mackinnon Jacobs Lawyers.

What areas of litigation are covered?

Litigation involving businesses can be due to:

  • Simple debt collection or defending against debt collection
  • Suing for supply of faulty goods and services
  • Subcontractor disputes
  • Construction disputes
  • Disputes between business partners
  • Disputes between shareholders
  • Disputes between Directors of Companies
  • Claims against professional advisers (For more information on how we can ensure your business is protected, visit our Professional Negligence section)
  • Landlord and tenancy agreements

Can I resolve the dispute myself without involving lawyers?

If you feel you can resolve the situation amicably without lawyers, then you should do so.

We seek and encourage any way of resolving issues which avoids going to court. We can assist with this process, which includes negotiation, mediation or arbitration.

If you feel overwhelmed by a dispute, or too emotionally involved, then engaging an experienced litigation lawyer enables you to step back and see the bigger picture. Knowing where you stand legally, and in particular knowing the risks you face, will often minimise the stress of  dealing with a dispute.

If you are dealing with a significant business interest, such as a shareholder, and there are issues with other shareholders, things can get very messy, very quickly.

In any legal dispute, you also need to be aware of the impact of relevant legislation,  the Common Law and any overlap between them. It can sometimes be the case that there is no easy answer.

To save you worry and the emotional toll of stress, spend time with our expert lawyers who are able to handle all issues ranging from small debt claims to large and complex matters.

Mackinnon Jacobs Lawyers are accessible and provide exceptional advice to all litigation matters.  Call or contact us via email to gain more clarity and peace of mind.
